Instead of facing a deadline of Jan. 1, the White House on July 2 delayed implementation of the employer health care mandate for employers with 50 or more employees until Jan. 1, 2015.

The one-year delay is significant, said Frank Gasperini, executive vice president of the Vienna, Va.-based National Council of Agricultural Employers.

“A huge percentage of family farms growing labor-intensive crops were going to be swept up in this starting Jan. 1,” he said.

Gasperini said the delay won’t reverse the health insurance law but employers should have a few months in 2014 to figure out how to comply with the law.

“It’s not getting us out of it, but it’s the next best thing,” he said.

Gasperini said the delay may give the agricultural industry more time to lobby for legislative help to make Obamacare work better for seasonal businesses.

“It will be an opportunity to get a far better definition of what a seasonal employee is and better ways of understanding how to manage the costs and still comply with the law,” he said.

 Businesses with less than 50 workers are not subject to the law’s employer shared responsibility mandate.
