Fresh Marketing Inc., Landisville, N.J., and its major stockholder Ralph Donato Jr. are currently banned from doing business in the produce industry, according to the U.S. Department of Agriculture.

According to the Feb. 6 notice, filed under the Perishable Agricultural Commodities Act, the company failed to pay more than $304,000 that was awarded to an Arizona produce company.

A civil case filed in the U.S. District Court of New Jersey in January by Spectrum Produce Distributing Inc., of Tuscon , Ariz., had requested that Fresh Marketing be ordered to pay $304,298 due for produce plus another $100,099 in attorney and legal fees.
