(Jan. 30, 2:09 p.m.) One lawsuit already has been filed and Perishable Agricultural Commodities Act trust claims could total as much as $5 million against a Dallas-area brokerage.

Ben Parker Inc., Rockwall, Texas, was named the defendant in a Texas Northern District Court suit filed by Idaho Falls, Idaho-based Eagle Eye Distributing Inc.

According to court documents filed Jan. 15, Eagle Eye Distributing has more than $1.1 million in outstanding claims against Ben Parker Inc.

The claims could be much higher, said Steve DeFalco, an attorney with the Naples, Fla.-based Meuers Law Firm, who is representing other claimants.

“I think there’s going to be about $5 million owed to produce creditors,” he said. “Everything came about within a four- to six-month period.”

DeFalco said he is representing seven companies with claims but his firm continues to receive inquiries.

A hearing in the Eagle Eye Distributing case is scheduled for Feb. 4.

Representatives from Ben Parker Inc. could not be reached for comment. A recording on the company’s main phone line stated, “Due to a personal tragedy, our offices are closed at this time.”
