WASHINGTON, D.C. — The U.S. Department of Agriculture has cited 10 produce businesses for failure to pay reparation awards issued under the Perishable Agricultural Commodities Act, according to a news release.


The businesses below have been barred from operating in the produce industry until their awards are paid. The businesses were served complaints by USDA and were given the opportunity to respond. USDA ordered payment of the amounts mentioned.


The businesses are:



  • RPM Sales & Marketing Inc., Nogales, Ariz., for failing to pay a $20,178 award in favor of a California seller. The sole officer, director, and stockholder is Steve Varela.
  • Hilz Produce LLC, Rio Rico, Ariz., for failing to pay a $34,004 award in favor of a California seller. The sole member is Hector Sanchez.
  • Produce Inc., San Jose, Calif., for failing to pay a $16,216 award in favor of a California seller. The officers, directors, and major stockholders are Elaine O’Neil, Charles O’Neil and Susie O’Neil.
  • Sandler Bros., Biddeford, Maine, for failing to pay a $76,700 award in favor of a Massachusetts seller. The officer, director, and major stockholders are James Sandler and Herbert Sandler.
  • La Esperanza Produce, Bronx, N.Y., for failing to pay a $21,328 award in favor of a New York seller. The sole proprietor is Rafael Veras.
  • Riverwood Produce Sales Inc., Hendersonville, N.C., for failing to pay a $43,931 award in favor of a Florida seller. The officers, directors, and major stockholders are Kevin Case and Roger Case.
  • Flatow Riley Inc., Cincinnati, for failing to pay an $8,793 award in favor of an Ohio seller. The sole officer, director, and stockholder is Rodney Caminiti.
  • Liberty Foods Inc., N. Wales, Pa., for failing to pay a $34,635 award in favor of a Pennsylvania seller. The sole officer, director, and stockholder is Robert Towns.
  • Big Boy Produce LP, McAllen, Texas, for failing to pay a $14,160 award in favor of a Georgia seller. The officers, directors, and major stockholders are D. Salinas Management LLC, Garrett Mann Management LLC, Garrett Mann, and Daniela Salinas.
  • Double D Trade Company LLC, Bellevue, Wash., for failing to pay an $18,468 award in favor of a California seller. The sole member is Igor Ryaboshapka.

PACA provides for damages to be paid by those not meeting their contractual obligations in buying and selling fresh and frozen fruits and vegetables.

USDA is required to suspend the license of a business that fails to pay PACA reparations awarded against it. Individuals, partners, members, officers, directors, or major stockholders associated with these businesses may not be employed by or affiliated with any PACA licensee without USDA approval.
